1. Definition and scope of these Terms of Use.  These Terms of Use govern your and our rights and obligations in connection with the use of our guest Wi-Fi access.

 

2. Our services

(1) We provide you with free Internet access on our business premises in the form of a Wi-Fi hotspot.
(2) The provision of the hotspot depends on our technical and operational capabilities. There is no entitlement to a functioning hotspot or a certain signal range.
(3) We do not guarantee uninterrupted operation of the hotspot or any specific network speed.
(4) We reserve the right to interrupt, restrict, or suspend access due to necessary maintenance and repair work without prior notice.
(5) There is no entitlement to the use of specific services via the hotspot. For example, certain ports may be blocked. In general, browsing the Internet and sending and receiving emails is possible. 


 

3. Access and use

(1) We offer our Wi-Fi access exclusively to visitors to our café. It is not a publicly accessible telecommunications service, but an internal Wi-Fi for our guests.
(2) A prerequisite for use is prior registration for the hotspot and/or acceptance of these Terms of Use. This usually takes place via an online registration form or a welcome page after you have selected the hotspot as a Wi-Fi network on your device.
(3) There is no entitlement to use the hotspot. We reserve the right to restrict or block access to the hotspot at any time and without stating reasons.
(4) The current version of these Terms of Use, which is made available to you when you register for hotspot use, shall apply.

 

4. Login data

(1) All login data that you provide during registration (e.g. username, password, email address, etc.) must be treated confidentially and protected against unauthorized access by third parties.
(2) If login data has been provided to you, it may only be used by you as the user to access and use the hotspot. Should circumstances arise that suggest unauthorized third parties have obtained or will obtain your login data, you must inform us immediately.
(3) As a user, you are liable in accordance with the statutory provisions for any use and/or other activities carried out using your login data.

 

5. Your responsibilities as a user

(1) When using the service, all personal data entered by you must be truthful and correct.
(2) When using our hotspot, you are obliged to comply with the applicable laws.
(3) Further obligations arising from other provisions defined in these Terms of Use remain unaffected.

 

6. Fees 

The service is offered free of charge.


 

7. Availability of the service

Since our services are free of charge, we are not obliged to allow you to use the hotspot. However, we will make every effort to ensure uninterrupted service at all times.

 

8. Prohibited activities

When using the hotspot, all activities that violate applicable law, impair the rights of third parties, or violate youth protection laws are prohibited. In particular, the following activities are prohibited:

  • uploading, distributing, offering, or advertising content, services, and/or products that are fraudulent or pornographic, or that violate youth protection law, data protection law, and/or other laws;
  • publishing or making available content that is insulting or defamatory to other users or third parties;
  • use, provision, or distribution of content, services, and/or products that are legally protected or subject to third-party rights (e.g. copyright) without express permission;
  • making copyrighted works publicly available or engaging in other copyright-infringing activities, in particular through the use of Internet exchange platforms or file-sharing services;

Regardless of any possible legal violation, the following activities are prohibited when uploading content to the service provider's website or when communicating with other users (e.g. by sending personal messages, participating in discussion forums, etc.):

  • the mass transmission of large amounts of data and in particular their continuous transmission;
  • hosting a web server or any other server via a hotspot of the service provider;
  • changing the default DNS servers in the network settings of the service provider's hotspot;
  • sending junk or spam emails as well as chain letters;
  • the distribution of viruses, Trojans, or other harmful files; 
  • the distribution of insulting, indecent, sexual, obscene, or defamatory content or messages, as well as any content or messages that could be used to support or promote racism, bigotry, hatred, physical violence, or illegal activities (explicitly or implicitly);
  • requesting other users or third parties to disclose their passwords or personal data for commercial or unlawful/illegal purposes;

Also prohibited are all activities that could impair the smooth operation of our hotspot, in particular anything that places an excessive load on our systems.


 

9. Blocking user access

We may temporarily or permanently block a user's access to the hotspot if we have concrete indications giving rise to the suspicion that you are violating or have violated these Terms of Use and/or applicable laws, or if we have another legitimate reason for blocking access. 


 

10. Indemnification

(1) As a user, you bear full responsibility for all your activities in connection with the use of the Internet via our hotspot.
(2) You hereby indemnify us upon first request against all third-party claims asserted against us arising from the user's violation of statutory provisions, infringement of third-party rights (in particular personal rights, copyrights, and trademark rights), or breach of contractual obligations, warranties, or guarantees, including all costs of legal defense (attorneys' fees and other costs at the statutory rate).
(3) In the event of claims pursuant to Section 10 paragraph 2, you are obliged to cooperate immediately and fully in clarifying the facts and to provide us with all necessary information without delay.


 

11. Limitation of liability

(1) We are liable without limitation for all damages caused by us intentionally or through gross negligence.
(2) In cases of slight negligence, we are liable without limitation for damage to health, personal injury, or death. (3) Otherwise,
we are only liable if we have breached essential contractual obligations. Essential contractual obligations are generally obligations that are indispensable for the proper and contractual performance of this agreement and on whose fulfillment the user may ordinarily rely. In these cases, liability is limited to compensation for foreseeable damage typical for the contract.
(4) To the extent that our liability is excluded or limited under the above provisions, this also applies to our representatives and vicarious agents.
(5) Liability under the Product Liability Act remains unaffected.


 

12. Data protection

(1) We ensure that your personal data is collected, stored, and processed only to the extent necessary for the provision of the contractually agreed services and as permitted or required by law.
(2) Should you be asked for your consent under data protection law in the course of using our services, you will be informed that you may revoke this consent at any time with effect for the future.
(3) In order to provide you with hotspot services, we require personal data from your end device. This means that the MAC addresses of end devices may be stored temporarily. In addition, we may store log files for up to 7 days that record the type and scope of use. These data do not allow any conclusions to be drawn about your person.


 

13. Final provisions

(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If you are a merchant, a legal entity under public law, or a special fund under public law, our registered office shall be the exclusive place of jurisdiction for all disputes in connection with this contract.
(3) Should individual provisions of these Terms of Use be or become invalid, this shall not affect the validity of the remaining provisions.
